David M. Powell

David M. Powell practices in the areas of business litigation, construction law, banks and banking, commercial transactions, real estate, professional liability and commercial arbitration. He was born in Little Rock and graduated from Phillips Academy, Andover, cum laude. Mr. Powell received his Bachelor of Arts Degree cum laude from Davidson College, where he was elected to Phi Beta Kappa. He received a Juris Doctor Degree with high honors from Duke University, where he was a member of the Order of the Coif.

Mr. Powell practiced law for thirty-two years with the Little Rock firm of Wright, Lindsey & Jennings LLP, until he withdrew as a partner in 2003. He has spoken at national and local seminars on defending claims against professionals, representing financial institutions in litigation, various construction topics and dispute resolution. As a former adjunct instructor at the William H. Bowen School of Law, University of Arkansas at Little Rock, Mr. Powell has taught classes on the Uniform Commercial Code and Real Estate.

Significant matters successfully handled by Mr. Powell include litigation on large hydroelectric projects constructed on the Arkansas River and defense of one of the early lender liability cases in the Eighth Circuit. Most recently as lead counsel, his client, an international accounting firm, prevailed against a regional drug chain after full hearing on claims of malpractice.

Mr. Powell is a member of the Panel of Arbitrators of the American Arbitration Association, the International Association of Defense Counsel. He is a Fellow of the Arkansas Bar Foundation and the Defense Research Institute. He is listed in Best Lawyers in America under Commercial Litigation, Construction Law, Franchise Law and Professional Malpractice Law; in Chambers USA as a “Leader” in the field of General Commercial Litigation; and in Mid-South Super Lawyers in the areas of Business Litigation, Construction Litigation and Professional Liability: Defense.
