Marie-Bernarde Miller
Marie-Bernarde Miller focuses her practice primarily on commercial and business law, including employment defense, title insurance defense, deceptive trade practices defense, and contract disputes. She also serves as Legal Counsel to the Commissioners of the Arkansas Judicial Discipline & Disability Commission.
Professional Background
Ms. Miller is a former Deputy Prosecuting Attorney, Deputy Attorney General over the Medicaid Fraud Control Unit, and Special Assistant U.S. Attorney for Health Care Fraud issues. As a former Hearing Officer for the Arkansas Department of Health & Human Services she heard numerous cases involving alleged violations of nursing home regulations. Ms. Miller coordinated and defended a series of class action lawsuits involving claims of violation of the Real Estate Settlement Procedures Act and the Arkansas Deceptive Trade Practices Act. She was also lead counsel in American Abstract & Title Co., v. Stewart Title Guaranty Company, 363 Ark. 530, 215 S.W.3d 596 (2005), which involved claims of interference with business expectancy. Ms. Miller has represented a national retail department store chain in a series of cases involving racial profiling and false imprisonment claims, including Crutchfield v. Dillard’s, Inc., U.S.D.C. No. 4-02-0074; a national distributor of the popular energy drink, Niagara®(Pfizer, Inc. v. Williams, et al., U.S.D.C. No. 4-01-CV-00210); a subsidiary of a well-known national hunters association involving trademark infringement, Arkansas Trophy Hunters Association, Inc. v. Texas Trophy Hunters d/b/a Arkansas Trophy Hunters Association, Case No. U.S.D.C. 2006-5067 (2007). Ms. Miller served as Special Counsel in the removal of the first state court judge in the history of the Arkansas judiciary, Judicial Discipline & Disability Commission v. Morris W. Thompson, 341 Ark. 253, 16 S.W.3d 212 (2000), and Special Counsel in the prosecution of the disbarment of President William Jefferson Clinton, Supreme Court Committee on Professional Conduct v. Williams Jefferson Clinton, Case No. 2000-5677 (2001).
Education
Ms. Miller received her Bachelor of Arts Degree from Maryville College (University) in St. Louis and her Juris Doctor Degree from the University of Kansas School of Law.
Professional/Civic Activities
Ms. Miller is admitted to practice in Arkansas, the Fifth, Sixth and Eighth Circuits of the Courts of Appeal, and the United States Supreme Court. She currently serves on the Central Arkansas Water Board and the Arkansas Prostate Cancer Foundation.
